WHEREAS by Section 84(1) of the Real Estate Act, S.A. 1995, c. R-4.5 (the “Act”), the Real Estate Council of Alberta (the “Council”) has the power, duty and responsibility to amend or repeal bylaws and rules;
THEREFORE BE IT RESOLVED THAT: Rule 5(3) under the Real Estate Act, S.A. 1995, c. R-4.5 shall be amended from
5(1) An individual who intends to apply for a licence shall first meet the educational requirements or other qualifications, if any, prescribed, adopted or approved by the Council for that category of licence.
(2) An individual who intends to apply for a licence shall first write the examinations prescribed, adopted or approved by the Council for that category of licence and pass those examinations with a grade that is satisfactory to the Council.
(3) The Executive Director may grant an exemption from any or all of the examinations required under subsection (1) to:
(a) an applicant who has been previously licensed in Alberta as a broker, associate broker or agent, as the case may be, and has been unlicensed for a period of up to 36 months preceding the date of application, or
(b) an applicant who satisfies the Executive Director that the applicant has satisfactory experience and knowledge of current real estate or mortgage broker practices in Alberta, as the case may be.
